Description
In a significant development concerning US immigration enforcement, Yogesh Dabhi, a Gujarati Green Card holder living in the United States, was taken into federal custody upon arriving at a US airport. Following his detention, Dabhi filed a habeas corpus petition in the US District Court for the Southern District of Texas (Houston Division), arguing that his constitutional rights and due process were violated.
However, the federal court dismissed his petition on August 31 after government attorneys presented details of his past criminal convictions, resulting in a combined seven-year sentence. Under US immigration law (INA Section 1182), permanent residents returning from abroad can be treated as "arriving aliens" or applicants for admission if they have certain criminal convictions, stay outside the US for over 180 days, or enter without inspection.
In this video, we break down the full court proceedings, why the habeas petition failed, the strict legal grounds DHS uses to detain returning Green Card holders, and what this means for immigrants with minor offenses like DUI or past convictions.
