Description

The Constitutional Court has ruled in favour of the ANC, ordering the IEC to include 181 previously excluded ANC candidates in the 4 November 2026 municipal elections. But the victory has triggered controversy surrounding Justice Rammaka Mathopo, ANC Secretary-General Fikile Mbalula and the Democratic Alliance. In this episode, we examine how the ANC failed to complete its candidate-list submissions, lost its challenge in the Electoral Court and eventually secured victory at the Constitutional Court. We revisit Justice Mathopo's tough questions about the IEC's final submission button, whether administrative procedures can have the force of law, and whether voters should lose their preferred candidates because of a technical requirement. We also examine the public criticism of Mathopo, including comparisons with his judicial position in the Phala Phala case involving President Cyril Ramaphosa. Do these decisions raise legitimate concerns about judicial independence, or is the criticism politically motivated? Meanwhile, Fikile Mbalula has called for a review of the ANC's relationship with the DA in the Government of National Unity. The DA maintains its right to challenge the ANC through lawful democratic processes. The episode also covers Mbalula's emotional press briefing and subsequent collapse, the public's divided reactions, and the debate about whether political leaders receive equal privacy and sensitivity when experiencing health emergencies. We also consider comparisons being made with the media treatment of former President Jacob Zuma during his periods of ill health. **Topics covered:** ANC vs IEC | Justice Mathopo | Constitutional Court | Phala Phala | Fikile Mbalula | DA and GNU | Jacob Zuma | Judicial independence What do you make of the Constitutional Court's decision and the criticism directed at Justice Mathopo?
