Description
Two extra years cost Julie $92,000 in taxable gain on a house she'd owned since 2012 because she rented it out for eight years instead of six.
A rule lets you move out of your own home, rent it to strangers for six full years, sell it, and pay nothing on the growth. It isn't a loophole.
It's section 118-145, and the Tax Office publishes worked examples showing you how to use it.
But it has five ways to break it, and two of them aren't administered by the Tax Office at all.
Chapters:
00:00 Julie's $92,000 mistake
00:59 Five ways this rule breaks
01:47 What "choose" actually means
02:48 The part almost nobody knows
03:34 Once per property is wrong
04:33 Trap 1 - one home at a time
05:38 Trap 2 - what year seven costs
07:57 Trap 3 - land tax's own six-year rule
10:23 Trap 4 - Centrelink uses twelve months
12:10 Trap 5 - the one that wipes it out
13:31 Can the rent actually fund it?
14:26 Rent or sell?
WHAT'S IN THIS ONE
- What the absence rule actually says - and why "choose" is the word doing all the work
- The part almost nobody knows: the six years only counts time the property is EARNING RENT. Vacant time doesn't burn the clock. The ATO's own example runs ten years away and is still fully covered.
- Why the six-year limit is NOT once per property - it applies to each period of absence, and a genuine move back restarts it
- Trap 1: you only get one main residence at a time, and the six-month overlap most people rely on is already closed to you if the house has been rented
- Trap 2: what year seven costs, worked through end to end
- Trap 3: land tax is a completely different six-year rule, with the opposite ending - and a normal twelve-month tenancy at market rent fails it
- Trap 4: Centrelink uses twelve months, not six years
- Trap 5: the one that wipes out the entire exemption with a single signature
- And the honest answer to whether the rent can actually fund retiring at 55
Everything here was checked against the ATO, Revenue NSW and the Social Security Guide on 10 September 2026. Where the law isn't settled yet - and on one point it genuinely isn't - I say so on air instead of guessing.
WHICH STATE ARE YOU IN? The state answer changes everything on this topic, and it's the part where local knowledge beats general advice. Tell me in the comments, along with one word: RENT or SELL.
Subscribe if you want the next one. It covers the other half of this problem - most people assume super and the Age Pension are separate systems. They aren't, and the way your balance is counted means $200,000 in super can cost you more pension than $400,000 sitting in the family home.
GENERAL ADVICE DISCLAIMER
This video is general information only. It does not take into account your objectives, financial situation or needs, and it is not personal financial or tax advice. Laws and thresholds change, and the figures quoted are current as of 10 September 2026.
Before acting on anything here, speak to a registered tax agent or a licensed financial adviser about your own circumstances.
A note on how this video is made:
Every script starts with real research and is checked against current ATO and Services Australia figures - that part isn't automated. The narration and the visuals are produced with AI tools. I write, verify, and stand behind every word.
Thanks for being here.
