Description
In the autumn of 1968, three Amish fathers in Green County, Wisconsin, were criminally charged for refusing to send their fourteen and fifteen-year-old children to high school. They were convicted and fined five dollars each. What happened next climbed all the way to the United States Supreme Court — and ended in one of the most cited religious liberty decisions in American history, won by men who had never set foot in a high school themselves.
This is the full story of Wisconsin v. Yoder — how a people who believe their own Bible forbids taking disputes before a judge ended up defending their entire way of life in the highest court in the land, and won six to one.
We'll explore:
- Why an American high school represented everything the Amish faith exists to reject
- The Green County trial, and the testimony from a sheriff, a social services director, and a leading Amish scholar that the state couldn't answer
- Why the Amish fought this case at all, despite a religious rule against lawsuits
- Chief Justice Warren Burger's landmark opinion, and the single dissenting voice that asked a question the Court never answered
- What happened when the Amish went back to the Supreme Court a decade later — and lost
- How Congress ultimately wrote into law what the courts wouldn't grant
This isn't just a legal history lesson. It's the story of the quietest, most court-averse people in America discovering they had no choice but to fight — and what that fight still protects, and doesn't, fifty years later.
