📘 Get Know Your Rights here: https://knowrightsuk.gumroad.com/l/know-your-rights Two in the morning, a custody suite, and somebody behind the desk says the friendliest thing you'll hear all night: "You can have a solicitor, but honestly, it'll only slow things down." It sounds like help. The police's own code of practice has a rule against saying it. It's one of three helpful-sounding things you may be told at a police station that can cost you far more than a few hours. Here is what we cover: What you must give: your name when charged; fingerprints, a DNA swab and a photograph after arrest for a recordable offence (PACE ss.61, 63, 64A) Thing one, "it'll only slow things down": PACE s.58, free legal advice 24 hours a day (Code C 6.1), the rule against dissuading you (Code C 6.4) and against suggesting you'll be out quicker (Note 6ZA), and why turning a solicitor down changes what your silence means (CJPOA 1994 s.34(2A)) Thing two, "just accept a caution": a simple caution needs an admission of guilt and forms part of your criminal record. Standard and enhanced DBS checks for six years, travel and ESTA, and the right to advice and to see the evidence before you agree (MoJ guidance paras 9, 77, 78) The held one, "a quick chat before the tape": what counts as an interview (Code C 11.1A), the whole of it recorded (Code E), comments outside the interview written down (11.13) and put to you on tape (11.4) Say this, played out Everything here is tied to real sources: legislation.gov.uk (Police and Criminal Evidence Act 1984, Criminal Justice and Public Order Act 1994, Criminal Justice Act 2003, Rehabilitation of Offenders Act 1974), gov.uk (PACE Codes C 2023 and E 2018, simple cautions guidance, DBS filtering guide, legal advice at the police station, FCDO USA entry requirements). Checked October 2026. One honest note. For someone who genuinely did something minor and has had proper advice, accepting a caution can be the right outcome. The point is to decide with a solicitor and the evidence, not at the desk at four in the morning. FREE HELP FIRST. The duty solicitor is free, at any hour, at any police station, under arrest or voluntary. You can ask at any point, even if you said no at the start. 📘 Get the full handbook on stops, the station and what to say: https://knowrightsuk.gumroad.com/l/know-your-rights England and Wales — Scotland is a separate legal system. General information about published law, not advice about your situation. Give your name when the law requires it, never lie, and never resist. Ever been held at a police station?
