A police captain has opposed the release of Mr Karim on bail, arguing that the circumstances surrounding his arrest and his attempted departure from South Africa raise concerns that he could evade further court proceedings.
During the bail hearing, the officer testified that Karim was intercepted at an airport while attempting to leave the country after his passport had been flagged on the police system. According to the testimony, the authorities had been instructed to notify the police if he attempted to travel internationally.
The captain told the court that Karim indicated he was travelling to Saudi Arabia for a pilgrimage and had verbally stated that he intended to return to South Africa on 28 December 2026.
However, the officer testified that Karim could only produce a one-way ticket to Dubai and did not provide a return ticket. The arrest reportedly took place at approximately 03:43.
Dispute Over Karim’s Residential Address
The bail proceedings also focused on whether the police had adequately verified Karim’s residential address.
The captain testified that investigators had identified properties allegedly linked to Karim in Johannesburg, including Houghton and Sandton, as well as a property in Cape Town. However, he acknowledged that he had not personally visited the addresses to verify where Karim lived.
When questioned about whether the police could locate Karim if he failed to attend future court proceedings, the officer said the address provided needed to be physically verified.
Karim’s defence challenged this position, presenting documents indicating that an address in Mafikeng had been associated with him for approximately 17 years.
The defence questioned why the police could not confirm the address through their records and argued that the officer’s objection was based largely on his failure to verify it personally.
Police Admit Previous Cases Were Not Verified
The captain further testified that a police profile compiled during the investigation reflected previous cases associated with Karim, but those cases had reportedly been withdrawn.
Under questioning, the officer acknowledged that investigators had not yet completed the necessary verification to establish the nature of those cases or the reasons for their withdrawal.
The defence challenged the suggestion that Karim might commit further offences, pointing to an official South African Police Service police clearance document indicating that he had no previous criminal conduct.
The officer responded that investigators wanted to revisit the withdrawn cases in light of concerns about alleged interference in the criminal justice system that had emerged during the broader commission proceedings.
However, when pressed by the court, he acknowledged that he could not, at that stage, provide evidence under oath demonstrating that Karim had interfered with decisions to withdraw those cases.
Defence Questions the Alleged Flight Risk
The defence also challenged the suggestion that Karim was attempting to evade justice by travelling abroad.
Counsel questioned why Karim should have been expected to notify investigators of his travel plans when the docket was reportedly opened after 14 August and the investigating team had not contacted him to inform him that he was being investigated.
The captain maintained that Karim was aware that he was expected to appear before the commission and that a matter involving him had been registered.
However, the court emphasised the distinction between the criminal complaint before it and the wider allegations or evidence discussed during the commission proceedings.
The questioning focused on whether the state could demonstrate that Karim intended to evade the specific criminal proceedings, rather than relying on broader concerns arising from his alleged involvement as a person of interest.
