Description

‎#SouthAfrica #CourtNews #BailHearing #BreakingNews #LegalProceedings ‎The court has refused the State’s request to postpone a bail application, allowing proceedings to continue after the defence challenged concerns about the accused’s residential addresses, criminal history and alleged plans to leave South Africa. ‎ ‎The State’s request to delay bail proceedings was rejected after a heated exchange in court over the accused’s residential addresses, travel arrangements and alleged criminal history. ‎ ‎During the proceedings, the defence argued that the State had failed to provide sufficient justification for postponing the bail application, insisting that the accused’s constitutional rights and the interests of justice should be considered. ‎ ‎The defence told the court that the accused had lived at an established address in Mafikeng, North West, for approximately 17 years. Counsel said the address had previously been used by the commission to serve summonses and was also reflected in municipal documentation. ‎ ‎The defence questioned why the State needed additional time to verify the address, arguing that the charge against the accused concerned a failure to appear before a commission and provide documents, rather than fraud or another serious offence. ‎ ‎Counsel further submitted that the court could impose reasonable bail conditions, including requiring the accused to report to a police station and accompany investigators to verify his residential address. ‎ ‎State Raises Concerns Over Alleged International Travel ‎ ‎Opposing the defence, the State argued that investigators needed more time to establish the accused’s residential address and verify information relating to previous cases that reportedly appeared on his criminal profile. ‎ ‎The prosecutor told the court that investigators had identified several addresses associated with the accused, including locations in Johannesburg, Cape Town and Mafikeng. The State said it needed to establish which address was his principal residence. ‎ ‎The State also revealed that the accused had allegedly been arrested at approximately 20:43 the previous evening while preparing to board an international flight to Dubai. ‎ ‎According to the prosecutor, the accused was travelling with substantial luggage and had not produced a return ticket when requested by investigators. The State argued that these circumstances raised concerns about whether he intended to return to South Africa. ‎ ‎The prosecutor maintained that investigators had not been given sufficient time to complete the necessary verification and asked the court to postpone the matter. ‎ ‎Defence Disputes State’s Claims ‎ ‎The defence rejected the suggestion that the accused intended to leave South Africa permanently, explaining that the trip had been planned with his wife and included religious travel for Umrah, followed by a visit to Pakistan before returning home. ‎ ‎Counsel said a return-ticket itinerary was available through the accused’s wife and could be provided to the State. ‎ ‎The defence also presented a South African Police Service clearance certificate dated 23 June 2026, which counsel said showed that the accused had no criminal history. ‎ ‎Regarding the addresses, the defence maintained that Mafikeng was the accused’s main residence. Counsel explained that a Johannesburg property belonged to the accused’s company, Diggy Diggy Investments, and was occupied by his son. Another property in Athol, according to the defence, was rented to a tenant and was not occupied by the accused. ‎ ‎The defence insisted that the State’s concerns did not justify delaying the bail application. ‎ ‎Court Allows Bail Proceedings to Continue ‎ ‎After considering the competing submissions, the court refused the State’s request for a postponement, ruling that the bail application could proceed. ‎ ‎The proceedings then moved towards the presentation of evidence, with the State indicating that it intended to call the investigating officer, identified during the hearing as Captain Sukai Nede. ‎ ‎The court subsequently began the process of administering the oath to the officer before questioning him about his occupation, rank and police station. ‎ ‎The refusal to postpone the matter means that the bail proceedings can continue, although the ultimate decision on whether bail should be granted will depend on the evidence and arguments presented to the court. ‎ ‎The bail outcome had not yet been announced in the portion of proceedings provided. ‎ ‎#SouthAfrica #CourtNews #BailHearing #BreakingNews #LegalProceedings ‎ ‎South Africa court news, bail hearing, State opposes bail, court rejects postponement, bail application, SAPS, investigating officer, criminal justice system, Mafikeng court, North West news, Dubai travel allegations, South African legal news, constitutional rights, Diggy Diggy Investments, breaking news South Africa ‎
