Description

Get Make Them Pay here: https://knowrightsuk.gumroad.com/l/make_them_pay If you take a prescription medicine and you drive, this video is about you, and I suspect you have never once thought it was. Not somebody taking something illegal. Somebody on codeine for a bad back, or diazepam after a difficult year, or morphine after an operation, taken exactly as the doctor said. There is a defence written into the Act for that person โ€” and one sentence, printed on a leaflet inside the box you almost certainly threw away, that can take it off you completely. ๐Ÿ“‹ WHAT THIS VIDEO COVERS โ€” The correction almost every video on this gets wrong: the roadside swab does not test for your prescription โ€” The other door into the station, which is impairment and has nothing to do with a swab โ€” What the station blood test actually reaches, and how far beyond the swab it goes โ€” Section 5A(3), the medical defence, and the three elements you need all of โ€” Section 5A(4), and how a line about the interval between taking it and driving removes the defence โ€” Section 5A(5), and the one piece of genuinely good news: you raise it, they must disprove it โ€” The three things to do: say it early, keep the box, take the free solicitor ๐Ÿ”Ž SOURCES Section 5A of the Road Traffic Act 1988 โ€” (3) for the medical defence, (4) for how it is lost, (5) for where the burden sits. Home Office approved roadside screening devices and what each detects. Every section is on screen as I read it, from legislation.gov.uk. โš ๏ธ THE PART TO REMEMBER The defence is not lost because you took your medicine. It is lost if you acted contrary to advice about the interval between taking the drug and driving โ€” and that includes the manufacturer's instructions, which means the leaflet in the box. Read as health advice, "do not drive until you know how this affects you" is a caution. Read as section 5A(4), it is the condition your defence hangs on. Same sentence, two jobs, and only one is obvious. Go and find the box tonight. Read that line, and keep it somewhere you can find it again. FREE HELP FIRST. The duty solicitor at a police station costs you nothing, ever. Citizens Advice will look at paperwork with you for free. And your pharmacist will tell you what a leaflet means in about ninety seconds. Always the free route before anybody paid. ๐Ÿ“˜ Make Them Pay โ€” every script on this channel in one place, plus five template letters with the parts you fill in marked in brackets: https://knowrightsuk.gumroad.com/l/make_them_pay England and Wales only. This is general legal education about a published section of an Act โ€” not advice about your medication, your fitness to drive, or your case. I am a solicitor but not your solicitor, and I am not a doctor. Whether you are fit to drive is a question for your doctor or pharmacist. Do you take a prescription medicine and drive? Type the county, nothing else. #knowyourrights #ukdrivers #drugdriving #ukLaw #roadtrafficact
