Description
📕 Make It Last — how to keep a modified, loaded, towing ute out of the dealer's bad books 👉 https://aussiemechanicgreg.com
There's a paragraph in every new-vehicle warranty book in Australia saying the guarantees cannot be excluded under the Australian Consumer Law. So how does a bloke with a lift and a tune walk in with a dead turbo and walk out with a quote?
Because a dealer can't take your warranty off you. What they can do is point at one modification, say it caused the failure, and hand you the cost of proving otherwise. Here are the seven that give them that sentence, the three that can't be used against you, and the folder that makes trying expensive.
What I cover:
- The 50mm rule that's an AGGREGATE of springs and tyres, the 15mm a passenger car really gets, and why oversized tyres come back as hubs, bearings and ABS
- The flash counter in your ECU — why flashing back to stock doesn't hide it, and which claims it really costs you
- Emissions deletes: not a grey area, penalties reported over $2,500 in QLD and thousands per offence in NSW
- GVM upgrades done before vs after registration, who warranties what afterwards, and the towing capacity it does NOT raise
- The FCAI-commissioned tray testing (and who paid for it), plus "abnormal use" — the door the law gives them
- Spliced wiring: the one mod where who fitted it decides the whole claim
- The 3 they CAN'T touch: servicing it anywhere you like, compliant bolt-on gear, and any failure the mod didn't cause
- The folder, the $11 weighbridge ticket, and the one email to send before the next modification
FACT-CHECK: The ACCC's guide A guide to Australian consumer law — Motor vehicle sales and repairs states consumer guarantee rights cannot be excluded by contract and apply regardless of any manufacturer's warranty; that any suggestion a vehicle needs servicing at a licensed dealer to maintain those rights "is not correct"; that an independent repairer can service a vehicle without affecting them; and that making dealer servicing a warranty condition may be anti-competitive conduct under the Competition and Consumer Act 2010. The same guide sets out the mandatory warranty-against-defects text quoted in this video, permits a warranty to require servicing by qualified staff to the manufacturer's specification with appropriate quality parts, notes a defect caused by an independent repairer is unlikely to be covered by the manufacturer, excludes the acceptable-quality guarantee where an owner uses a vehicle abnormally (a term the Act does not define), gives the 1,000kg tray as an express-warranty example, and states a consumer can apply to a tribunal or court for a determination. ACCC: on 14 February 2024 the Federal Court ordered Mazda Australia to pay $11.5m over misleading or deceptive conduct and false or misleading representations to nine consumers about consumer guarantee rights, having found 49 such representations; the appeal was dismissed 23 March 2023. The Motor Vehicle Service and Repair Information Sharing Scheme commenced 1 July 2022, with penalties to $10m. VSB14/NCOP11: a 50mm ride-height increase is a basic modification on an ESC vehicle, engineer certification is required above that, the 50mm is an aggregate of suspension and tyres, and rolling diameter may increase 50mm on off-road passenger and commercial vehicles against 15mm on a passenger car; NSW, VIC and QLD are reported to allow 75mm where each part stays within 50mm. AS 4876.1-2002 requires an airbag vehicle's bullbar to be certified or designed for that model. Disabling a factory emissions control device on a registered vehicle breaches Australian emissions law. Pre-registration GVM upgrades use federal Second Stage Manufacture and a new compliance plate; post-registration ones are state-certified, reported at $800–$1,800, and do not raise GCM or braked towing capacity. Toyota Australia's warranty terms state a failure caused by fitment of a non-genuine part or by faulty workmanship by a non-authorised technician is not covered. Drive reported FCAI-commissioned testing of two aftermarket ute trays at Toyota Australia's Melbourne engineering centre: cracked chassis rails, rapid corrosion, weld quality rated unacceptable, trays separating from mounting points. Costs are indicative and vary by state, workshop and engineer.
DISCLAIMER: General information and my honest opinion — NOT legal, engineering, insurance or purchasing advice, and not advice about your vehicle, your warranty document or your dispute. Warranty terms differ between manufacturers and modification rules are set state by state and change over time. Nobody named or described here — dealer, manufacturer, tuner, bar maker, tray builder, workshop, engineer or industry body — is accused of any wrongdoing, and no claim is made that warranty refusals are increasing. Read your own warranty document, keep your invoices and certificates, and get any answer about your own vehicle in writing.
