Description
Christine Marino returns to Judge Boyd's courtroom in a felony evading-arrest case that has already been delayed again and again.
Her attorney says this is roughly their 10th appearance. Judge Boyd says the plea deadline has been extended repeatedly since April and makes one thing clear: today the case is either getting resolved or going to trial.
But Marino still cannot seem to make a decision.
As she becomes visibly emotional, Boyd tells her nobody is forcing her to take the deal. She can accept the three-year prison sentence or exercise her right to a jury trial.
Then Boyd calls out the display directly: "I don't see a tear falling from your eye."
The hearing also reveals that Marino previously had a two-year plea offer. Her attorney says she backed away from that deal before court resumed, while the prosecutor disputes that timeline and says the earlier offer had already been revoked following a prior failure to appear.
Either way, Judge Boyd explains that a prosecutor can revoke a plea offer before the judge accepts it.
The offer now is three years.
And the state isn't bluffing about trial. Prosecutors tell Boyd their witnesses are already present and they could begin selecting a jury that day.
Marino ultimately enters a no-contest plea to evading arrest or detention with a vehicle.
The state also waives an enhancement based on Marino's prior prison history that otherwise could have increased her punishment range from 2–10 years to 2–20 years.
Then Judge Boyd reviews the allegations behind the charge.
According to the evidence, a passenger jumped from Marino's vehicle and Marino struck him with the vehicle. A police pursuit followed in which Marino allegedly disregarded multiple red lights and stop signs and drove in the wrong direction of travel multiple times.
Judge Boyd sentences Marino to three years in prison.
