Description

Attorney Mark Davis tells Judge Annabell Perez that he is ready for trial. Less than a minute later, that claim begins to fall apart. The opposing attorney says his side has spent roughly three months trying to schedule depositions, including around eight emails seeking dates. One deposition had been scheduled but was canceled, and the remaining discovery still has not been completed. Then Judge Perez discovers something else: the parties also never completed the mediation she specifically ordered. Davis describes the underlying dispute as a relatively simple injunction case involving allegations that the opposing side's client was doing donuts outside his client's home. He argues that the discovery period has already expired and says he wants to get the case finalized. Perez immediately sees a problem with that argument. If the other side has been trying to obtain deposition dates, she asks, can a party simply let the discovery deadline expire and then use that deadline to avoid being deposed? As Perez digs deeper, the explanations get worse. Davis had a vacation certificate. Another attorney in his office had a new baby. But opposing counsel says repeated emails seeking deposition dates still went unanswered. When Perez presses Davis about those emails, he responds: "I don't handle the emails personally." Davis points out that there are ten people in his office and says his paralegals handle the emails. Perez has a response of her own: his paralegal wasn't on vacation. Davis then acknowledges that he has not gone back and read the emails and says nobody brought the issue to his attention. Perez tells him he is effectively confirming what opposing counsel has been saying. Davis responds: "I'm an honest man. I don't lie." Perez answers: "Oh, great." The judge then calls out the central contradiction: Davis walked into court saying he was ready for trial even though depositions remained unfinished and the court-ordered mediation had never happened. And this isn't the first time the case has been set. Perez says this is already the fourth trial setting. Eventually, the judge stops waiting for the attorneys to coordinate and begins scheduling the depositions herself. She orders the depositions to begin October 23 at 1:00 p.m., continue into the following Monday if necessary, and orders mediation to occur within 30 days afterward. Perez also makes the consequence clear if her new orders are ignored: sanctions. 0:00 Lawyer Says He's Ready for Trial 3:23 Judge Perez Dismantles the Excuses 5:45 Fourth Trial Setting 7:33 Judge Takes Over and Warns of Sanctions #JudgePerez #Attorney #Lawyer #CivilCourt #CourtroomDrama #Discovery #Sanctions #CourtroomVideo #TexasCourt #GavelGazers Our channel aims to shed light on the judicial process and the individuals responsible for delivering justice to the community.
