Description

In a Senate hearing, Senator Sheldon Whitehouse presses Interior Department nominee Mr. Lily with one simple question: Is there really a 350-foot gash in the Reflecting Pool? The president has claimed that vandals cut into the pool with a knife or blade. The estimated length grew from 250 feet to 300, then to 350. Meanwhile, U.S. Park Police have arrested visitors at the Reflecting Pool. The nominee said he believed there were five arrests. Whitehouse lays out the sequence: the claim, the arrests, and the factual basis behind them. Asked directly whether the damage exists, the nominee repeatedly said he stood by his statement and pointed to an ongoing investigation. In this video, I break down what probable cause means, why a straight answer matters, and what this exchange shows about how arrests are supposed to work in America. Footage is from a public Senate hearing. This video is commentary and analysis for news and educational purposes.
