Description

After being taken off a flight, a passenger in Florida told officers she was a sergeant and an army veteran, insisted she was not high, and then threatened to spit on them and have them killed. Leg restraints followed, and the original report lists two felony counts of battery on law enforcement officers and resisting with violence. In a second incident, officers at a Texas airport found a traveler passed out near her gate. She denied drinking, gave the wrong date, and was arrested for public intoxication, a Class C offense with a fine of up to $500.
Are threats shouted at officers protected speech or a crime? How can a fine-only charge still lead to a night in custody? And when does a passed-out passenger become a medical call instead of an arrest?
This breakdown covers Virginia v. Black, Fla. Stat. § 784.07 and § 843.01, Tex. Penal Code § 49.02, Tex. Code Crim. Proc. art. 14.06, Atwater v. City of Lago Vista, and Graham v. Connor.
