On December 12, 2024, a visibly intoxicated passenger was denied boarding on a Southwest Airlines flight at Nashville International Airport. She repeated "I didn't do anything wrong" about a dozen times, insisted she was getting on the plane, and was arrested after refusing to stand or walk, later telling officers she had been drinking right by her gate. In a second case on November 3, 2024, officers answering a fight call at a gas station heard a couple deny everything, then heard two witnesses describe closed-fist punches. The woman was arrested, objected to a search, and struggled at the facility while saying she was pregnant.
Was the Nashville arrest public intoxication, disorderly conduct, or both under Tennessee law? Can police arrest a spouse for assault when the alleged victim says nothing happened? And does anyone need consent for a search after arrest?
This breakdown covers Tenn. Code Ann. §§ 39-17-310, 39-17-305, and 39-16-602, Chimel v. California, United States v. Robinson, and Graham v. Connor.
