On February 11, 2024, police responded to a Frontier ticket counter at Orlando International Airport after a passenger, upset over a $292 fee for three checked bags, admitted she threw a water bottle at an agent's head. She was arrested for battery, banned from flying with Frontier, and trespassed from the airport. In a second Florida airport encounter, a traveler argued with deputies over trash on the floor, refused to put her hands behind her back, and was taken to the ground, then charged with disorderly conduct and resisting an officer without violence.
Did her own admission create probable cause for battery, even though she later said the bottle never hit? Can profanity toward a deputy support a disorderly conduct charge under Florida law? And does an arrest become invalid when no one reads Miranda rights?
This breakdown examines Florida Statutes Sections 784.03, 877.03, 843.02 and 810.08, along with Terry v. Ohio, Graham v. Connor, Miranda v. Arizona and State v. Saunders.
