Description
#airport #bodycam #passengerrights
On October 17, 2022, at a Florida airport, a passenger was removed from a Delta flight after the plane returned to the gate. Insisting she needed the carry-on that held her valuables, she headed back toward the aircraft, and a crew member later told deputies that an agent had been pushed. Deputies, a TSA inspector, and the captain then pieced together what happened, including a gate-check tag that meant the bag was already headed to its final destination.
This breakdown covers the airline's power to refuse transport under 49 U.S.C. 44902, crew-interference rules in 14 C.F.R. 121.580, the 49 U.S.C. 46318 civil penalty, and Florida's trespass and battery statutes.
Does a removed passenger have any right to re-board for property? When does a shove on a jet bridge become battery? Can a civil FAA penalty follow even without an arrest?
