At a Georgia airport, Delta Sky Club staff told officers a woman had been aggressive at the A17 and T lounges and had already been told not to return. Officers asked her to leave, she said "I will happily go," and after a sarcastic "you can do both" to the choice of leaving or jail, she was handcuffed while insisting "I told you to go, I'm going." In custody, she threatened officers repeatedly. In a second incident, a gate agent removed an intoxicated passenger from an aircraft, and an officer told her she was not in trouble but had to leave the terminal. Minutes of "don't touch me" later, the escort ended in an arrest.
Can police still arrest someone who has agreed to leave? When do threats shouted in handcuffs become a crime? And can refusing to walk during an escort count as obstruction?
This breakdown covers O.C.G.A. §§ 16-7-21, 16-10-24, and 16-11-37, Atwater v. City of Lago Vista, Virginia v. Black, Counterman v. Colorado, and Graham v. Connor.
