On December 15, 2022, Tampa Airport Police found a traveler too unsteady to walk after her flight was canceled and she spent time at a terminal bar. Officers brought a wheelchair and offered her a ride home instead of jail, but she told them no one was coming for her. Minutes later her boyfriend answered the phone, the argument resumed, and an official trespass warning ended in handcuffs. In a second incident, a 62-year-old passenger at a boarding gate said another traveler had choke-held her and thrown her to the ground, then was arrested herself after a long standoff with officers.
Did either woman's conduct meet Florida's disorderly intoxication standard, or was it a welfare call that went wrong? Was a trespass warning followed by an arrest within seconds a fair chance to comply? And does a federal airport violence statute really apply to shouting at a gate?
This breakdown covers Fla. Stat. § 856.011, § 810.08, § 843.02, Atwater v. City of Lago Vista, Graham v. Connor, and 18 U.S.C. § 37.
